PA Consent Divorce
Attorney Gearty, a central PA divorce lawyer, handles cases under section 3301(c) and 3301 (d) of the PA divorce code.
Section 3301 (c) is the section of the divorce code that permits a consent divorce. Under this section, the first step is to file a divorce complaint. After the divorce complaint is filed, there is a ninety day waiting period. Once the waiting period expires, the consents can be filed and the divorce decree can be entered.
If the other spouse won’t sign the divorce consent, then, after one year of separation, a divorce decree can be entered under section 3301 (d) of the PA divorce code. Here, the date of separation is important and an attorney should be consulted to help to determine the exact date of separation.
